La inteligencia artificial transforma el derecho. No es solo un modo de facilitar la actividad jurídica. Tiene implicaciones epistemológicas y sociales. El derecho se reduce a datos y a cálculos. Prospera un jurista maquinal. Se empobrece la racionalidad jurídica. Se olvida que la clave del derecho no es el procesamiento de datos sino la creación de sentido.

El antes y un después del comienzo de la guerra de Ucrania muestra los cambios en la opinión de los ciudadanos ante la seguridad y la defensa. No es igual en todos los países de la UE. Habrá que ver si la percepción del riesgo y la forma de hacerle frente se mantiene conforme se alarga la guerra y las consecuencias colaterales. En los gobiernos de la UE existe una cacofonía estratégica semejante a la de los ciudadanos cuando aceptan de (...) manera desigual los costes para garantizar la seguridad colectiva. Una percepción y respuesta desigual como desigual es la realidad de la UE. Las _europas _de la UE dificultan que se realice de manera cómoda los esfuerzos creadores equiparables a los peligros que la amenazan. Esfuerzos tanto en el poder blando, como en el duro. Los líderes estratégicos en la UE al margen de la retórica deben reconocer las amenazas, tomar decisiones políticas y llevar a cabo el esfuerzo continuado para reducirlas. Los ciudadanos del común aportan en número suficiente y por ahora el apoyo en ese sentido. Que en la UE no se desaproveche tanto esfuerzo del pueblo de Ucrania. (shrink)

Tanto es así que Rawls en la Teoría de la Justicia lo eleva a la categoría de bien primario más importante. El ser humano que se estima y respeta a sí mismo está dotando a su vida de un incalculable sentido moral y convierte su existencia en un proyecto pleno y meritorio. La autoestima proporciona al individuo un sentido de su propia valía (...) y le asegura la confianza necesaria para emprender y desarrollar un proyecto de vida significativo. La humillación y la vergüenza menoscaban las bases del autorrespeto y suponen un daño a la dignidad humana. (shrink)

Resumen: Las nuevas tecnologías biomédicas han planteado la posibilidad de intervenir en la capacidad de decisión sobre el bien y el mal, es decir, en la evaluación de la moralidad de los actos humanos. Aunque estas intervenciones (genéticas o neurológicas) no pretenden alterar la identidad del individuo, sus planteamientos no lo descartan. En consecuencia, el dilema entre terapia y mejora, en el contexto moral, adquiere especial relevancia. Aunque la terapia intentaría restaurar la capacidad individual para decidir entre el bien y (...) el mal, la mejora biomédica plantea otros objetivos para los que es necesario abordar los fundamentos de la entidad humana, en particular algunos conceptos filosóficos como la identidad y la autonomía. Desde la filosofía moral, el desarrollo del individuo debe estructurarse fuera del campo tecnológico y abordar una perspectiva que considere el factor relacional y la existencia del otro como elemento fundamental para alcanzar la plenitud del ser humano. Abstract: The new biomedical technologies have raised the possibility of intervening in the decision-making capacity regarding good and evil, that is, in the evaluation of the morality of human acts. Although these interventions (genetic or neurological) do not intend to alter the identity of the individual, their approaches do not rule it out. Consequently, the dilemma between therapy and improvement, in the moral context, acquires special relevance. Although the therapy would try to restore the individual capacity to decide between good and evil, biomedical enhancement raises other objectives for which it is necessary to address the foundations of the human entity, in particular some philosophical concepts such as identity and autonomy. From moral philosophy, the development of the individual must be structured outside the technological field and approach a perspective that considers the relational factor and the existence of the other as a fundamental element to achieve the fullness of the human being. Resumen En el presente artículo repasaremos someramente algunos de los hitos más reseñables de la historia militar del Imperio Romano Tardío, haciendo hincapié en el papel de los bárbaros que luchaban junto a los romanos, puesto que la barbarización del ejercito romano ha sido uno de los puntos de referencia en las investigaciones acerca de la decadencia y caída del Imperio Romano. En este sentido, haremos referencia al papel integrador que tuvo el ejército romano durante buena parte de la historia (...) del Imperio Romano, y señalaremos los principales hechos que condujeron al final de dicho papel; esbozando también las desastrosas consecuencias que tuvo este hecho para el futuro del Imperio, especialmente del Occidental. In this sense, we will refer to the role played by the Roman army in the integration of foreigners during a large part of the history of the Roman Empire. In addition, we will point out the main events that led to the end of this integrating role; we will also indicate the disastrous consequences this fact had for the future of the Empire, especially for the Western part. Los procesos de industrialización provenientes de la primera Revolución Industrial alcanzaron a España y a Aragón con un importante retraso. Dentro del amplio abanico de sectores industriales, el de la generación energética resultó indispensable para acelerar los procesos productivos y promover mejoras tecnológicas. En Aragón, al igual que en otros lugares, las estructuras nacidas del sector energético modificaron paisajes y dinamizaron el territorio en el que se ubicaron, constituyendo una fuente de riqueza y modo de vida para sus gentes. Muchas (...) de esas estructuras generadoras de energía ya cerraron sus puertas, pero, en la actualidad, forman parte de un rico Patrimonio industrial estudiado por disciplinas como la Arqueología industrial. Lamentablemente, en Aragón, los poderes públicos encargados de su protección y reutilización mantienen sumido en un profundo abandono a los vestigios industriales relacionados con la generación energética a pesar de su evidente importancia histórica, económica y social. Within the wide range of industrial sectors, energy generation was essential to accelerate production processes and promote technological improvements. In Aragon, as in other places, structures born from the energy sector modified landscapes and energized the territory in which they were located, constituting a source of wealth and way of life for its people. Many of these energy-generating structures have already closed their doors but, at present, they are part of a rich industrial heritage studied by disciplines such as industrial archeology. Unfortunately, in Aragon, the public authorities in charge of their protection and reuse keep industrial vestiges related to energy generation in deep abandonment despite their obvious historical, economic and social importance. El Espacio Europeo de Educación Superior (EEES) establece que el aprendizaje debe estar centrado en el estudiante. Partiendo de este enunciado, el artículo explica cómo la gamificación puede ser una técnica pedagógica que propicie el ansiado cambio en la docencia universitaria hacia donde marca el EEES. Este trabajo presenta el diseño de una metodología de gamificación sencilla y fácil de implementar en un Grado de Ingeniería utilizando Kahoot! como herramienta y su evolución a lo largo de tres cursos académicos. The Air Quality Index (AQI) shows the state of air pollution in a unique and more understandable way. This work aims to forecast the AQI in Algeciras (Spain) 8 hours in advance. The AQI is calculated indirectly through the predicted concentrations of five pollutants (O3, NO2, CO, SO2 and PM10) to achieve this goal. Artificial neural networks (ANNs), sequence-to-sequence long short-term memory networks (LSTMs) and a newly proposed method combing a rolling window with the latter (LSTMNA) are employed as the (...) forecasting techniques. Besides, two input approaches are evaluated: using only the data from the own time series of the pollutant in the first case or adding exogenous variables in the second one. Several window sizes are employed (24, 28 and 72 hours) with ANNs and LSTMNAs. Additionally, several feature ranking methods are applied in the exogenous approach to select the most relevant lagged variables to feed the models. Results show how the proposed exogenous approach increases the performance of the prediction models. Besides, the newly proposed method LSTMNA provides the best performances in most of the cases evaluated. Hence, it constitutes an exciting alternative to standard LSTMs and ANNs to predict pollutants concentrations and, consequently, the AQI. (shrink)

The objective of this research is to develop accurate forecasting models for chlorophyll-α concentrations at various depths in El Mar Menor, Spain. Chlorophyll-α plays a crucial role in assessing eutrophication in this vulnerable ecosystem. To achieve this objective, various deep learning forecasting techniques, including long short-term memory, bidirectional long short-term memory and gated recurrent uni networks, were utilized. The models were designed to forecast the chlorophyll-α levels with a 2-week prediction horizon. To enhance the models’ accuracy, a sliding window method (...) combined with a blocked cross-validation procedure for time series was also applied to these techniques. Two input strategies were also tested in this approach: using only chlorophyll-α time series and incorporating exogenous variables. The proposed approach significantly improved the accuracy of the predictive models, no matter the forecasting technique employed. Results were remarkable, with |$\overline{\sigma}$| values reaching approximately 0.90 for the 0.5-m depth level and 0.80 for deeper levels. The proposed forecasting models and methodologies have great potential for predicting eutrophication episodes and acting as decision-making tools for environmental agencies. Accurate prediction of eutrophication episodes through these models could allow for proactive measures to be implemented, resulting in improved environmental management and the preservation of the ecosystem. Los autores de los evangelios, que escriben en griego y conocen bien el libro de Daniel, relacionan de manera directa el mensaje apocalíptico y mesiánico (...) que aparece en Daniel 7,13, y el uso trivial y cotidiano en arameo de la expresión autorreferencial, dando lugar a la interpretación de «el Hijo del hombre» como título salvífico o mesiánico. Through most of Christian history theologians have argued that God revealed Godself to the Christian church in a way unlike any other religious group. En esta entrevista se resolvieron las interrogantes formuladas y orientadas a la preservación de la lengua castellana en Hispanoamérica. En principio, se abordaron tres temas fundamentales derivados de esta propuesta: la escritura, la investigación y la publicidad. Con el primer tópico, se discernió la función de las normativas, los diccionarios y los manuales elaborados por la Real Academia Española. Su intervención es enjundiosa, ya que direcciona al lector y académico al perfeccionamiento de su lenguaje, con la finalidad de que no (...) reincida en errores gramaticales. El segundo rubro abarca la investigación. Esta fue destacada porque facilita la interacción de los hablantes de la lengua castellana con las metodologías que se instauran para configurar un lenguaje totémico. Además, se asume que la única manera de difundir y contribuir a ese conocimiento sería por medio de las publicaciones científicas. La tercera variante consiste en cómo se inserta esta inquietud en torno a la lengua castellana en los ámbitos publicitarios. Esto es neurálgico por su audiencia limitada y el desinterés de respaldo por los Gobiernos. Frente a ello, consideré que el Dr. Ignacio Bosque Muñoz era la persona idónea para confrontar esta realidad sobre el castellano. Su rol importante en la RAE y la Asociación de Academias de la Lengua Española (ASALE) lo amerita, así como sus publicaciones orientadas al estudio del idioma con enfoques gramaticales. Con su interacción, la volición de este trabajo se evidenciará con la explicación del panorama vigente de la lengua y su preservación, como cuando uno desea comprender el Quijote, entender las contribuciones gramaticales y lexicales de la RAE y la ASALE o cuestionar la proliferación del idioma desde los medios de comunicación. The literature on epistemic injustice currently displays a logocentric or propositional bias that excludes people with intellectual disabilities from the scope of epistemic agency and the demands of epistemic justice. This paper develops an account of epistemic agency and injustice that is inclusive of both people with and people without intellectual disabilities. I begin by specifying the hitherto undertheorized notion of epistemic agency. I develop a broader, pluralist account of epistemic agency, which relies on a conception of knowledge that accounts (...) not only for propositional knowing, but also for other types of knowing that have been largely neglected in debates on epistemic injustice and agency. Based on this pluralist account of epistemic agency, I then show that people with intellectual disabilities qualify as epistemic agents and therefore as subjects of epistemic justice. Finally, I argue that this pluralist account of epistemic agency pushes us to revisit the current conception of epistemic injustice and to expand its taxonomy in two important ways. (shrink)

The contrast between third- and first-personal accounts of the experiences of autistic persons has much to teach us about epistemic injustice and epistemic agency. This paper argues that bringing about greater epistemic justice for autistic people requires developing a relational account of epistemic agency. We begin by systematically identifying the many types of epistemic injustice autistic people face, specifically with regard to general assumptions regarding autistic people’s sociability or lack thereof, and by locating the source of these epistemic injustices in (...) neuronormativity and neurotypical ignorance. We then argue that this systematic identification pushes us to construe epistemic agency as resulting from a fundamentally relational and dynamic process between an individual, others around them, and their social, cultural, or institutional environment, rather than as a fixed and inherent property of individuals. Finally, we show how our relational account of epistemic agency allows us to introduce the novel concepts of epistemic disablement and epistemic enablement. We argue that these two concepts allow us to more accurately track the mechanisms that undermine or facilitate epistemic agency, and thereby to better understand how epistemic injustice arises and to design more effective interventions to foster greater epistemic justice for autistic people. I analyze the relation between deliberative democracy and trust through the lens of epistemic justice. I argue for three main claims: (i) the deliberative impasse dividing majority and minority groups in many democracies is due to a particular type of epistemic injustice, which I call ‘hermeneutical domination’; (ii) undoing hermeneutical domination requires epistemic trust; and (iii) this epistemic trust is supported by the three deliberative democratic requirements of equality, legitimacy, and accountability. In arguing for those claims, I contribute to the (...) conceptualization of both epistemic injustice and domination, as well as to discussions of trust and deliberative democracy. (shrink)

Explainable artificial intelligence has become a vitally important research field aiming, among other tasks, to justify predictions made by intelligent classifiers automatically learned from data. Importantly, efficiency of automated explanations may be undermined if the end user does not have sufficient domain knowledge or lacks information about the data used for training. To address the issue of effective explanation communication, we propose a novel information-seeking explanatory dialogue game following the most recent requirements to automatically generated explanations. Further, we generalise our (...) dialogue model in form of an explanatory dialogue grammar which makes it applicable to interpretable rule-based classifiers that are enhanced with the capability to provide textual explanations. Finally, we carry out an exploratory user study to validate the corresponding dialogue protocol and analyse the experimental results using insights from process mining and argument analytics. A high number of requests for alternative explanations testifies the need for ensuring diversity in the context of automated explanations. (shrink)

The traditional blackface character Black Pete has been at the center of an intense controversy in the Netherlands, with most black citizens denouncing the tradition as racist and most white citizens endorsing it as harmless fun. I analyze the controversy as an utter failure, on the part of white citizens, of what Alison Jaggar has called multicultural literacy. This article aims to identify both the causes of this failure of multicultural literacy and the conditions required for multicultural literacy to be (...) possible. I argue that this failure of multicultural literacy is due to hermeneutical injustice and to white ignorance. I close by considering possible avenues for fostering multicultural literacy. (shrink)

The philosophical debate on secession has hitherto revolved primarily around the question of self-determination rather than that of distributive justice. Normative theorists of secession have approached the question of secession mostly in terms of the right that the secessionist group has to secede. Much less attention has been paid to the extent and the nature of obligations or duties that the seceding group might have toward the group it is leaving behind. At best, secession theorists have introduced clauses to the (...) effect that secession should not undermine the remainder state’s viability nor violate prior arrangements of reciprocal cooperation. While these clauses certainly reflect a certain concern for distributive justice, I argue that they are insufficient in two respects: they are problematically minimal in what they require, and the justification given for these clauses accounts only for part of the normative picture. In this paper, I address these two shortcomings by arguing that the seceding group might have significant duties of distributive justice toward the remainder group, and that these duties are associative in nature and stem from a concern to secure non-domination within the pre-secession polity. What is gained from my non-domination account, then, is that it is analytically more comprehensive and normatively more accurate. In arguing for claims and, the paper contributes both to the debate on secession as well as to the conceptualization of associative duties and of non-domination. (shrink)

Because secession centrally involves taking away a territory, a successful normative theory of secession must give a credible account of when a seceding group has a valid territorial claim. One of the most prominent types of normative theory of secession is remedial theories of secession. I argue that while remedial theories address the question of territorial justification, they fail to do so adequately, because their account is both arbitrary and internally inconsistent. I argue that addressing the question of territorial justification (...) non-arbitrarily and consistently requires adopting a broader and morally more plausible conception of justice than that on which remedial theories explicitly rely; and I show that this broader conception of justice is implicit in remedial theories’ account of territorial justification. Recognizing this, however, has significant implications for remedial theories, as it considerably broadens the scope of valid territorial claims, and hence of valid secessionist claims. (shrink)

A systematic effort to rethink Freud's theory of the unconscious, aiming to separate out the different forms of unconsciousness.

The general aim of this article is to give a critical interpretation of post-trial obligations towards individual research participants in the Declaration of Helsinki 2013. Transitioning research participants to the appropriate health care when a research study ends is a global problem. The publication of a new version of the Declaration of Helsinki is a great opportunity to discuss it. In my view, the Declaration of Helsinki 2013 identifies at least two clearly different types of post-trial obligations, specifically, access to (...) care after research and access to information after research. The agents entitled to receive post-trial access are the individual participants in research studies. The Declaration identifies the sponsors, researchers and host country governments as the main agents responsible for complying with the post-trial obligations mentioned above. To justify this interpretation of post-trial obligations, I first introduce a classification of post-trial obligations and illustrate its application with examples from post-trial ethics literature. I then make a brief reconstruction of the formulations of post-trial obligations of the Declaration of Helsinki from 2000 to 2008 to correlate the changes with some of the most salient ethical arguments. Finally I advance a critical interpretation of the latest formulation of post-trial obligations. I defend the view that paragraph 34 of ‘Post-trial provisions’ is an improved formulation by comparison with earlier versions, especially for identifying responsible agents and abandoning ambiguous ‘fair benefit’ language. However, I criticize the disappearance of ‘access to other appropriate care’ present in the Declaration since 2004 and the narrow scope given to obligations of access to information after research. The recent crisis involving the territory of Crimea has been characterized both as a case of wrongful annexation and as one of rightful secession. Territory and competing territorial claims lie at the heart of the normative questions of secession and annexation. Any normative theory of secession or of annexation must therefore address their territorial aspect: It must explain why one agent rather than another has a valid claim to the disputed territory. One of the most interesting, yet controversial, normative accounts (...) of secession has been offered by choice theorists of secession. Choice theorists adopt a rather permissive stance, based on the normative significance of political self-determination. Choice theories, however, have been widely criticized for failing to provide a satisfactory account of what legitimates the seceding group’s territorial claim. This article argues that it is possible to remedy choice theories’ failure to address the question of territorial justification adequately. To do so, this article offers a two-tier account of territory that is grounded in the normative significance of self-determination. It defends this account of territory by showing that it is implied by our normative condemnation of annexation. It argues that the same reasons that warrant opposition to annexation provide support for secession. In closing, this article revisits the case of Crimea in light of its two-tier account of territory, and considers what role international law and institutions might play in addressing this type of situation. The term “innovation” or “innovative care” has recently gained attention in the context of the use of novel and not yet fully validated medical interventions and technologies. Most notably, there have been various incidences of medical activities insufficiently validated for its regular use in healthcare that fall into this category, such as stem cell treatments, genome sequencing for diagnostic purposes, or novel reproductive technologies. Latin American countries are among the places where new and non-validated medical activities take place, notably due (...) to a lack of clear regulations and the poor support of authorities of existent legal and ethical guidelines, which is driven by “hidden battles” on the moral status of certain interventions. The increasing importance of innovative care underlines the importance of developing a general framework for these practices. Therefore, the present chapter scrutinizes this nascent field of inquiry in Latin America and offers a conceptual framework for innovation as well as its ethical justification. As we will argue, an important use of the term “innovation” or “innovative care” is best interpreted as “new non-validated practice” and not as a research activity. Then, we will defend that responsible innovation understood as responsible new non-validated practice is ethically permissible and poses an acceptable medical option if done in exceptional circumstances—where no reasonable alternatives can be provided to an individual patient—and following special ethical principles. Finally, we focus on the peculiarities and specific difficulties the concept of new non-validated practice poses to the Latin American context. We will conclude the chapter by some remarks and recommendations we draw from our analysis for individual patients, doctors, and societies in Latin America. (shrink)

The extent to which people anticipate and are influenced by the potential future consequences of their current behavior is called Consideration of Future Consequences. A well-established tool to measure this construct is the 14-item Consideration of Future Consequences Scale. The CFC-14 has shown appropriate psychometric properties in several languages. This scale comprises two factors: the CFC-Immediate and the CFC-Future. The main goal of this study was to assess the psychometric properties and internal consistency of the CFC-14 Scale in Spanish, using (...) an Argentine sample. A secondary goal was to determine its convergent validity with impulsivity, and determine differences across gender and age groups. Using a web-based survey, we collected data from 512 participants aged 13-74 years. Confirmatory Factor Analysis showed a 2-factor model as the best solution for 13-items version. Standardized regression weights ranged from.50 to.66 for CFC-F and between.43 and.83 for CFC-I. Composite reliability was also adequate: CFC-F achieve? =.80 and CFC-I? =.82. There were no differences across gender and age. The CFC-F subscale and UPPS-P subscales correlations, were negative and significant, highlighting the negative and moderate correlation between CFC-F and the lack of premeditation, a dimension strictly related to intertemporal decisions making. Thus, CFC-14 has adequate psychometric properties in an Argentinian population, although more studies are necessary to determine the robustness of these findings. (shrink)

En cambio, acorde al camino iniciado por van Fraassen en The empirical stance, optamos por definirlas como stances: políticas, estrategias o perspectivas a partir de las cuales construimos creencias fácticas. Así, en primera instancia nos dedicamos a entender qué es una stance y cómo caracterizar esta noción. En (...) segundo lugar, exploramos metodologías y enfoques para tratar el realismo y el antirrealismo como stances, y, en esta clave, definirlos adecuadamente. Por último, examinamos el impacto de esta propuesta en la explicación de los acuerdos y desacuerdos en el debate, evaluando los grados de afinidad o distancia en las perspectivas en juego. (shrink)

My goal is to show how Aquinas' doctrine of providence, mainly as expressed in his De Potentia Dei, fulfils the criteria for an account of divine action: that God's action is providential in the sense that God is involved in the individual (...) and particular here and now. -/- .
